Happy New Year!! As we start a new decade, here are a couple of “legal” resolutions we should each make for the new year:
• Meet with your insurance agent and review insurance coverage. The State of Alabama recently took a step backwards in protecting drivers. While Alabama does require a mandatory $25,000.00 in liability insurance coverage, all too often people obtain a monthly policy when they need to renew their tags or get their license and then let the coverage lapse. If you are stopped by a police officer, you have to show proof of insurance. If you are unable to produce proof of insurance, you are subject to certain penalties and fines. As of January 1, 2020, those penalties and fines have been reduced. The number of uninsured drivers on our highways is tremendous. Meet with your agent make sure you have sufficient liability coverage to protect your personal assets as well as plenty of uninsured/underinsured motorist coverage to protect you in case you are injured by an uninsured driver!
• Make a Durable Power of Attorney and Last Will and Testament. Sickness and death is something none of us want to think about. Unfortunately, it comes for all of us. A durable power of attorney allows you to appoint someone to make financial and medical decisions for you in the event you are physically and/or mentally incapable of making them yourself. A Last Will and Testament allows you, instead of the State of Alabama, to determine how you want your real and personal property distributed upon your death. Furthermore, if you have children under the age of 19, you will be able to determine who will raise and care for your children instead of the State. A Durable Power of Attorney and Last Will and Testament are the cheapest way to save your family unnecessary angst and stress during a very difficult time.
